Copyright & DMCA Policy
Effective Date: September 1, 2025 · Last Updated: September 1, 2025
Hatch Social ("Hatch", "we", "our", or "us") respects the intellectual property rights of content owners and creators. We expect all users to do the same and strictly prohibit the unauthorized use, reproduction, or distribution of copyrighted material.
This policy describes how we handle copyright claims, takedown requests, and repeat infringers, in compliance with the U.S. Digital Millennium Copyright Act (DMCA) and international copyright standards.
Section 01
What Is Copyright Infringement?
Copyright infringement occurs when someone uses, reproduces, distributes, or displays another person's protected work without permission or a legal exception. Examples include:
- Uploading someone else's music, photos, or videos
- Selling digital or physical items using copyrighted logos or artwork
- Reposting exclusive content from another platform without a license
- Using AI-generated content based on copyrighted input data without rights
Section 02
Copyrighted Works on Hatch
All content uploaded to Hatch — including livestreams, images, products, posts, and storefront materials — must either:
- Be fully owned by the user
- Be licensed for commercial or public use
- Be used with valid legal permission (e.g., royalty-free licenses)
Users must ensure they have the right to use all materials they publish on the platform.
Section 03
How to Submit a DMCA Takedown Notice
If you believe your copyright has been infringed on Hatch, send a written DMCA-compliant notice to our Designated Agent. Your notice must include:
| Required Element | Description |
|---|---|
| Identification of copyrighted work | Title, URL, or description of the work |
| Location of infringing material | A direct Hatch link (URL) to the content |
| Your contact information | Name, mailing address, phone number, email |
| Statement of good faith | You believe the use is unauthorized |
| Perjury clause | Statement that your claim is accurate and truthful |
| Signature | Digital or physical — typing your name is sufficient |
Email: [email protected]
Incomplete notices may be rejected or ignored.
Section 04
How Hatch Responds to Takedown Requests
Upon receiving a valid notice:
- We remove or disable access to the allegedly infringing content
- We notify the uploader and provide a copy of the notice
- We log the notice for repeat-infringer tracking
- We notify both parties if a counter-notice is received
We aim to process valid notices within 5–10 business days.
Section 05
Counter-Notice Process
If your content was removed and you believe it was wrongly flagged, you may submit a counter-notice. It must include:
| Required Element | Description |
|---|---|
| Identification of removed content | Link or reference to the removed post |
| Statement of good faith | You believe content was misidentified or removed in error |
| Consent to jurisdiction | Agree to resolve in U.S. federal court (or applicable region) |
| Contact information | Full legal name, address, phone, email |
| Signature | Physical or digital (typed name is sufficient) |
We will forward your counter-notice to the original claimant. If they do not file legal action within 10–14 business days, we may reinstate the content.
Section 06
Repeat Infringers Policy
Users who receive multiple valid DMCA takedown notices may be permanently banned from Hatch.
| Offense Count | Action Taken |
|---|---|
| 1st Violation | Warning and content removal |
| 2nd Violation | Temporary suspension |
| 3rd Violation | Account termination and ban |
This policy applies whether or not the infringing content was monetized. Users attempting to evade enforcement may have their IP, device, or payment access blocked.
Section 07
Trademark and Other IP Infringement
If you believe someone is infringing your trademark, brand identity, or trade secrets — not copyrighted material — email [email protected] with:
- Evidence of ownership (e.g., registered trademark)
- A clear explanation of the violation
- Screenshots, links, and relevant documents
Hatch may remove infringing materials, restrict impersonators, and suspend accounts.
Section 08
False Claims and Abuse of Process
Section 09
International Rights Holders
We accept takedown requests under DMCA, EU Copyright Directive, UK Copyright, and international IP law. If you are located outside the U.S., we still require written confirmation under penalty of perjury and proof of IP ownership or exclusive licensing rights.
